Terms of Service

1. Who we are and acceptance

Forever Yours (the "Service") is operated by Big Dreams Group LTD, a company registered in Bulgaria (UIC/EIK 206986388), registered seat 42 Boulevard General Skobelev, Sofia, Bulgaria ("we", "us"). By creating an account or using the Service you agree to these terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account. You confirm that any child you add to a family profile is in your care and that you have authority to make decisions about their data on their behalf.

3. Your account

• You are responsible for the activity on your account. Keep your password safe.
• One account per person. Do not share account credentials.
• If you invite a co-parent, both of you have equal access to everything in the family. The Service is not built for situations where you need to restrict a co-parent's view.

4. Acceptable use

You must not use the Service to:

• Upload anything illegal, abusive, or that you do not have the right to upload.
• Add a child profile for a minor who is not in your care.
• Attempt to access another family's data.
• Probe, scan, or otherwise interfere with the security of the Service, except as part of a responsible disclosure to [email protected].
• Resell or rebrand the Service.

5. Your content

You keep ownership of everything you add - photos, reminder text, child profile data, captions, and notes. You grant us a limited licence to store, resize, transcode, transmit, and display your content solely to operate the Service for you and the co-parents in your family. We do not use your content for any other purpose: no training, no marketing, no sharing beyond the service providers described in our Privacy Policy. You are responsible for the content you add and for having the right to add it.

6. Our intellectual property

The Service itself - the software, design, brand, and the developmental content we publish - belongs to us or our licensors. We grant you a personal, non-transferable right to use it while you have an account. You may not copy, scrape, or redistribute the content or build a competing product from it.

7. Plans and billing

• The Service has a Free tier (500 MB of photo storage) and a paid Family tier (higher quota and additional features).
• Paid subscriptions are billed monthly or annually through our third-party payment processor. You authorise it to charge your payment method on each renewal until you cancel.
• You can cancel at any time from the app. Cancellation takes effect at the end of the current billing period. We do not refund partial periods unless the law requires it.
• If a payment fails, we retry on the processor's default schedule and downgrade your account to the Free tier if it remains unpaid.
• Prices are shown in EUR and include VAT where applicable.
• If you subscribe through an app store, that store's billing and cancellation terms also apply to the purchase.

8. Service availability

We work to keep the Service available but do not promise uninterrupted access. We may take it down for maintenance with as much notice as we can reasonably give, and we may change or discontinue features over time.

9. Termination

• You may delete your account at any time from Settings.
• We may suspend or terminate accounts that materially violate these terms, with notice unless waiting would compound the harm.
• On termination, the data deletion timeline in the Privacy Policy applies.

10. Health and content disclaimer

The developmental content in the Service is drawn from peer-reviewed pediatric and obstetric literature and is provided for general information. It is not a substitute for personalised advice from a qualified healthcare provider. Always consult your doctor, midwife, or pediatrician about your own or your child's health.

The Service is provided "as is". To the maximum extent permitted by law, we disclaim all implied warranties.

11. Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising from your use of the Service is limited to the greater of (a) the total amount you paid us in the 12 months before the claim and (b) 100 EUR. Nothing in these terms limits liability that cannot be limited by law - including, where applicable, our obligations under the GDPR and your statutory consumer rights.

12. Changes to these terms

We may update these terms. When we do, we update the "last updated" date above and email all account holders if the change is material. Continuing to use the Service after a material change means you accept the new terms.

13. Governing law

These terms are governed by the law of Bulgaria. Disputes that cannot be resolved informally will be heard by the competent courts of Sofia, Bulgaria - without prejudice to any consumer-protection rights that let you bring proceedings in your own country of residence.
